BM Pack (hereinafter referred to as “Company”, “us”, “we” or “our”)is a wholly-owned electronic platform subsidiary of THINKIN LIMITED. Please read these Terms and Conditions, Privacy Policy, personal information collection statement and disclaimer carefully before browsing this website https://www.bmpack.com (hereinafter referred to as “Website”). By using this Website or any part thereof, you agree to be bound by the Terms and Conditions of this Website.

1. Member Registration

You must register as our user before ordering/purchasing goods or services on this Website. During the process of registration, you commit to providing:

Your personal information and contact information, such as name, gender, date of birth, ID number, phone number, social media, email address, residential address, mailing address and/or billing address;
Your business information, such as company name and job title;
Your account information, such as the first and last 4 digits of your credit card account number or account number;
Your family income and personal interests; and
Your computer or mobile device IP address, real-time location data, browser settings, browsing history and/or other Internet logged information.

2. Order

The selling prices and discounts of all products are subject to the information currently displayed on this Website.
All items are billed in Hong Kong dollars.
You must complete the information on the online form to conduct online transactions.
Date of shipment is when after order submission, payment confirmation and production lead time.
The Company reserves the right to change the prices of goods without prior notice. All orders are subject to the Company’s sole discretion and are subject to stock availability or limited quantity of the goods.
After your online transaction is completed, we will confirm by email that we have received your order.
If you notify us there is a change of delivery address after confirming the order, the Company reserves the right to charge additional delivery fees.
All orders are subject to the stock availability before final confirmation. If the Company is unable to provide any goods or services on your order, we will notify you by phone or email and arrange for a refund on or before your requested delivery date.

3. Price & Payment

We will endeavour to ensure that the prices, information and sizes of the products listed on this website are correct; however, we reserve the right to change the prices and other information of the products without prior notice.
In the event that the price of an item is listed incorrectly, we reserve the right to reject or cancel orders that are listed with incorrect prices.
Goods ordered through this Website can be paid using Stripe.
This Website uses third-party payment services to conduct online transactions. When you place an order, you agree and accept that, governed to the Terms and Conditions, your credit card information will be collected, processed and retained by us and the payment service provider. You agree and accept that you are solely responsible for any losses incurred when conducting credit card transactions, and we shall not be liable for any such losses in whole or in part under any circumstances.
This Website may change the payment method at any time without prior notice.

4. Promotion, Promotional Offer & Discount Code

Unless otherwise specified, multiple discounts on this Website cannot be used at the same time (including the full order discount automatically applied by the system and the discount brought by the use of discount code).
The discount codes and promotional codes we provide are only valid for one-time purchases through our Website and are subject to the Terms and Conditions.
Discount codes and promotional codes cannot be refunded or exchanged for cash. Any remaining unused amounts will be forfeited.
We reserve the right to terminate or change the above offers. In the event of any dispute, our decision will be final and conclusive.

5. Delivery

We only deliver to industrial and commercial addresses within the Hong Kong Special Administrative Region (Hong Kong Island, Kowloon or the New Territories), excluding remote areas and outlying islands (including Tung Chung, Ma Wan, airport and other areas).
Delivery hours are Monday to Friday from 9am to 6pm.
Delivery times are preset for each region. If a specific delivery time is required, customers may have to pay additional fees.
Estimated delivery dates and times are for reference only, we are not responsible for customer’s losses caused by delayed delivery.

6. Draft Specifications & Terms and Conditions

All printed materials are subject to our company's colour management standards. Please do not rely on the colours on screens or printed paper. All your designs are printed in CMYK. If your design is in spot colour or RGB colouring, the design will be automatically converted to four-color (CMYK) without prior notice. Any colour differences caused will be determined based on the colours printed by us. We will not be responsible for any disputes regarding colour differences (except for special colour printing products).
We will not be responsible for any discrepancies between the finished product and customer’s requirements if the file submitted by the customer is different from the customer’s production requirements, it may include inconsistent size/insufficient bleed space/colour/cropping size/insufficient image resolution/lack of fonts, etc.
If a QR code or barcode is printed on the design, our Company will not guarantee that the information contained can be extracted normally.
All printings inherently have colour differences to some extent. In the case of reasonable colour differences, customers should not request any reprints, discounts or refunds, and we will not accept any requests of such. Our Company has colour management to ensure colour differences are within reasonable scope.
The Company only retains files submitted by customers for 3 months.
Regarding your use of our services, you guarantee that the printed materials do not contain any text, images, designs, trademarks, currencies and banknotes or any copyrighted works that are not authorised by the copyright holder; you guarantee that the printed materials will not infringe any rights of the third party, including copyright, trademark, publicity, privacy, will not defame or defame any third party, and have obtained all necessary authorisation or permission to incorporate third party materials into your work; you guarantee that you have obtained all necessary permissions, rights and authorisation to place an order and authorise the Company to print your work; if necessary, the Company will ask the customer to produce the relevant authorisation letter for verification.
If the printed content you provide involves or may involve defamation, invasion of privacy, counterfeiting, plagiarism, reproduction, infringement of intellectual property rights, indecentness, obscenity, infringement of any third party's rights, currency or banknotes, or violation of the laws in Hong Kong, the Company reserves the right to refuse printing of such content. To the maximum extent permitted by law, the Company will not bear any liability to users or any third party for the contents printed.
You promise that if any legal actions are taken by any person, group or organisation because (i) you violate the above terms of service; or (ii) any texts, photos, images, graphics or other materials in any product you entrust us to print involves or may involve defamation, invasion of privacy, counterfeiting, plagiarism, reproduction, infringement of intellectual property rights, indecentness, obscenity, infringement of any third party's rights, currency or banknotes, or violation of the laws in Hong Kong, you will indemnify the Company and its directors, managers and employees for any losses suffered, including but not limited to related claims, losses, costs and reasonable attorneys' fees.
The company has the right to make any final decision on whether to print or not. When you choose delivery service, the freight company will send the goods as quickly as possible. The time period selected by the customer is only the expected fastest time and period for order arrival. The Company is not responsible for any delays due to traffic, weather and unexpected happenings, nor customers should use the aforesaid as excuses for any claims or stock returns. Should customers request any specific time for delivery, [Special Delivery Service] can be considered. Details can be obtained from our hotline.

7. Return & After-Sales Service

You must check whether the goods delivered are damaged upon receiving them. If the goods are found to be damaged (limited to product quality problems, excluding intentional damage), please notify the Company within 7 days from the delivery date, and you must maintain the integrity of the returned items, such as quantity, packaging, or accessories. Items must be consistent with the order content, otherwise no returns or write-offs will be made.
If you have any claim for any order, our Company will only reprint or refund the relevant payment. We will not be responsible for any economic losses you may suffer.

Except for the refund or return circumstances listed above, our Company and this Website do not assume any responsibility for direct or indirect risks, losses and damages caused by your use of this Website for transactions, and you acknowledge that you use this Website at your own risk.
The Company will endeavor to ensure that the goods are delivered to the address before the delivery date according to the address you provided. If you are the reason for unsuccessful delivery after 60 days of estimated delivery date, the Company reserves the right to reject any requests for refund.
All customers who are requesting a refund must fill in the “Refund Application Form”. All personal information collected from the form will only be used for our internal refund procedure and will not be involved in other commercial activities.
The refund process takes four to six weeks from the date the refund request is made.
In the event of any dispute arising from refund or return, the Company reserves the right to make the final decision.
If our Company is unable to accurately provide the goods you need due to uncontrollable factors (including but not limited to natural disasters, fires, floods, accidents, riots, wars, government policies, strikes or any situation beyond our control), the Company will not bear any responsibility or compensate for any losses.

8. Privacy Protection

In order to protect your Personal Data privacy rights, we ensure that our policies and practices in collecting, using, retaining, transferring and accessing personal data comply with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) of the laws of the Hong Kong Special Administrative Region. 9. Disclaimer & Limitation of Liability

These Terms and Conditions will be interpreted in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, both you and the Company are subject to the jurisdiction of the Hong Kong courts. We may make rectifications and changes to these Terms and Conditions from time to time without giving you prior notice.
